Naked gardening complaint leads to Harrisburg official’s suspension

Editor’s note: A photo below of a naked man has been altered to obscure some features but some viewers may find it offensive.

Harrisburg’s finance director has been suspended after a neighbor snapped a photo of him gardening in the nude and called police to complain.

Bruce Weber is suspended pending the outcome of a police investigation.

The neighbor, ShaVonne Moon, posted a photo Friday on Facebook of her naked neighbor, bent over, pulling weeds in his backyard garden on Boas Street . She complained on her social media post that she’s “sick of it,” and had to keep her young sons away from her home’s windows and backyard to avoid seeing the naked man outside.

Weber confirmed Sunday that it was him in the photograph, but he did not wish to comment at that time. When reached for comment again on Tuesday, he said he would call back but did not.

Moon didn’t post her neighbor’s name, only his initials and that he was a city official, but the post spurred a lot of commentary and condemnation, with many people eventually figuring out her neighbor is Weber.

Moon said it was the second time she has seen Weber outside without clothes and said she reported both instances to police. But Mayor Eric Papenfuse said the city only has one record of a police call and it was placed Friday, the same day Moon posted her photo.

“This is being handled as an employment matter,” Papenfuse said. “The incident has been referred to Dauphin County (detectives) for investigation and Mr. Weber has been suspended pending the results of that investigation.”

Dauphin County District Attorney Fran Chardo confirmed his office was investigating for any possible crimes.

The state has a law against “indecent exposure,” which according to statutes involves someone exposing “his or her genitals in any public place or in any place where there are present other persons under circumstances in which he or she knows or should know that this conduct is likely to offend, affront or alarm.”

The crime is typically a second-degree misdemeanor but could be a first-degree misdemeanor “if the person knows or should have known that any of the persons present are less than 16 years of age.”

The state also has a law against open lewdness, a third-degree misdemeanor, which involves “any lewd act which he knows is likely to be observed by others who would be affronted or alarmed.”

Weber’s backyard appears to be fairly private and secluded for its Midtown location, but it still can be seen from Moon’s backyard and from an adjacent parking lot.

There is also a small alley that runs between Boas and Herr streets, which cuts between both of their yards. A person walking down either Boas or Herr streets, however, could not see Weber’s backyard.

 

Harrisburg police spokesman Sgt. Kyle Gautsch said Tuesday: “There was a complaint made and it is under investigation at this time.”

Since the case is under investigation, Gautsch said he could not release any more details.

Moon told PennLive through Facebook messages that other neighbors warned her that she may see a fully naked man in the backyard, but she didn’t see him until recently, when she took the photos. Her sons are 6 and 2. Moon said she rearranged her older son’s room to block his window.

Weber has been working as the city’s Finance Director since 2014, when Papenfuse was first elected. I'd like to see him pull up thistles or prune roses in the nude. This man is not a serious gardener or he would cover up every bit of sensitive skin that he could possibly cover. I think I am offended by his being called a gardener. Should I arrange a demonstration outside the nearest botanical garden or what? 

Seriously though what are her sons going to see that they don't see every day?

I guess if I were in her position...I'd be disgusted, too.  However, on the comical side of it, get a BB gun and shoot him in the rear and video the reaction.

Back yard Becky need a to keep her eyes on her side of the fence. Maybe he is just over heated from wearing a mask at work all day and needs to cool off at home by being nude. Also back yard Becky needs to be told that taking nude photos of someone and posting them online is a no no especially without their knowledge. As annoyed as she is that's wrong and I would be taking that up with someone.

Disclaimer-  I am kidding  about the mask part so nobody needs to get their panties in a bunch.

The man is on his own porch that has limited visibility. He is not doing anything lewd or lascivious. The human body is not in of itself lewd or lascivious. Actions may be but the human body is not unless one has a very unhealthy mindset.  Actually, all she is seeing is his white behind and since a thong bikini is acceptable on a beach what is she seeing that she wouldn't see on a beach? Unless she has her binoculars out she isn't seeing anything in detail. If the aesthetics displease her I hope she stays out of Wal-mart. She has gotten this poor guy in trouble with his employers because she is uptight about the human body. Feel sort of sorry to those two boys. What will they grow up believing about their bodies?

It is indeed. I believe the law is that you may take a picture of anything or anyone out in public. I don't see how you can claim a man's porch is out in public. If he sued I think he would win especially since she posted it on line.

Nope. 

He only has a remote claim to an expectation of privacy if he were to construct a fence that someone would have to make a reasonable effort to see past or over. An 8-foot, solid wooden fence may sufficiently meet that but, a chain-link fence does not.

If you can be seen from the street, a public place or by someone on their own property...you're in public. You have no expectation of privacy outdoors even if it is in your backyard.

It depends.  If this guy was easily visible from her house windows (she didn't have to climb a fence or sneak through the bushes) it is probably a legal picture.  However, her posting of the picture on her Facebook page could be seen as an attempt to humiliate or harass him.  Then she is in the wrong.  However, if a man took a picture of a female neighbor in the same situation, there is no doubt he would be called total pervert and should have to go through life labeled as a sex offender.

For the most part, you are allowed to photograph anything you see from a public space, with some exceptions, such as public restrooms.   If you are in a public space, say in City Park with your kids, I can take pictures of you and your children and you can't stop me and I don't need your permission.  I can even photograph you if you are in your front yard that is easily visible from the street.  I can even post those photos on my website, frame it and hang it in my gallery, or sell it as art.  I just can't use it for commercial purposes, such as putting it in an ad for my work.  Now, if you are in your fenced in backyard, where you expect privacy, then I would be in the wrong.

I am an avid, though mediocre, photographer.  Taking advice from a pro, I carry a copy of local and state laws and the guidelines of the venues (i.e. museums) I might want to visit as not all venues permit photography.  If you ask me nicely, I will probably stop taking pictures. I might even delete them at your request. If you ask, I will even send you copies of the pictures.  Threaten me, hit me, attempt to take my camera, and/or damage my equipment, I will have you arrested.  (I mostly likely have a picture of you!)

If he can show she posted with intent to harass, intimidate, or embarass him, he will most likely win a  lawsuit.

If you are sitting on your porch and wave to passersby or they wave at you, you have no expectation of privacy.

Mother Nature gives you the ability to close your eyes and/or turn your head. Use it.
